  AN ORDINANCE TO AMEND
TITLE 10
OF THE CODE OF EMMITSBURG
ENTITLED
VEHICLES AND TRAFFIC

BE IT RESOLVED, ENACTED AND ORDAINED
by the Mayor and Board of Commissioners of the Town of Emmitsburg, Maryland, pursuant to the authority granted to them by the laws of Maryland and the Charter of the Town of Emmitsburg, that Title 16 ; Section 16.48 of the Emmitsburg Municipal Code, be amended as follows.
           

The amended section of this regulation reads as follows with new wording indicated in BOLD, CAPITAL letters and deleted words in strike out.  

10.24.010 Definitions.  

As used in this chapter, the following terms shall have the meanings indicated:  

"Bicycle" shall have that meaning as defined for the term "bicycle" in title 11 of the TRANSPORTATION ARTICLE of the Annotated Code of Maryland and any subsequent amendments thereto.  

"Roller skate"--Any device worn on or attached to feet and which has two or more wheels attached for the purpose of gliding or rolling on a floor, sidewalk or other ground surface. "Roller skate" includes those devices commonly known as "roller skates," "roller blades," and "in-line skates."  

"Scooter"--Any wheeled, non-motorized device, similar in nature to a skateboard, which includes in its construction a vertical bar and handles which are used by the rider or operator for purposes of control and/or support.  

"Skateboard"--A short oblong board having two or more wheels at each end which is intended to be ridden.

10.24.020 Helmets required.  

A. THE PROVISIONS OF THIS SECTION APPLY:  

            1. AT ALL TIMES WHILE A BICYCLE IS BEING OPERATED ON ANY HIGHWAY, BICYCLE WAY, OR OTHER PROPERTY OPEN TO THE PUBLIC OR USED BY THE PUBLIC FOR PEDESTRIAN OR VEHICULAR TRAFFIC; AND  

            2. TO A PERSON UNDER THE AGE OF 16 WHO IS RIDING ON A BICYCLE, INCLUDING A PERSON UNDER THE AGE OF 16 WHO IS A PASSENGER ON A BICYCLE; OR

                a. IN A RESTRAINING SEAT ATTACHED TO THE BICYCLE; OR

                b. IN A TRAILER BEING TOWED BY THE BICYCLE.  

B. THE PROVISIONS OF THIS SECTION DO NOT APPLY TO PASSENGERS IN COMMERCIAL BICYCLE RICKSHAWS.

C.  A person TO WHOM THIS SECTION APPLIES may not operate, use or ride upon  as an operator or a passenger ON a bicycle , skate board, scooter or roller skates within the corporate limits of the town of Emmitsburg unless the person is wearing a helmet which THAT meets or exceeds the standards of the American National Standards Institute, the Snell Memorial Foundation,'s standard, or the standards of the American Society of Testing and Measurements MATERIALS for protective headgear for use in bicycling.

10.24.030 Violations and penalties.  

A violation of the requirements of this chapter shall be a municipal infraction. For a first violation, the offender shall be issued

THIS SECTION SHALL BE ENFORCED BY THE ISSUANCE OF a warning advising THAT INFORMS the offender of the requirements of this chapter SECTION AND PROVIDES EDUCATIONAL MATERIALS ABOUT BICYCLE HELMET USE. For a second, and each subsequent offense,an individual violating this chapter shall be fined twenty-five dollars ($25.00). (Ord. 09-08, § I)  

BE IT FURTHER RESOLVED, ENACTED AND ORDAINED that this Ordinance shall take effect on the date on which the Mayor approves the Ordinance after passing by the Board of Commissioners or on the date on which the Board of Commissioners pass the Ordinance over the veto of the Mayor.
